Introduction

This is a communication to inform you of our policy regarding all information we collect about you.

Sets out the conditions under which we may treat any information we collect from you or that you provide to us. It covers both information that could identify you (“personal information”) and information that could not.

In the context of the law and this policy, “processing” means collecting, storing, transferring, using or otherwise acting upon information.

We regret if there is one or more of the following points with which you are dissatisfied; your only recourse is to leave our website immediately.

We take the protection of your privacy and confidentiality very seriously. We understand that all visitors to our website have the right to know that their personal data will not be used for purposes not intended by them and will not accidentally fall into the hands of third parties.

We are committed to keeping all information you provide to us confidential and expect you to do the same. Our policy complies with correctly implemented Spanish law, including that required by the EU General Data Protection Regulation (GDPR).

We are required by law to inform you of your rights and our obligations to you regarding the processing and control of your personal data. We do this now, asking you to read the information provided at www.knowyourprivacyrights.org.

Except as noted below, we do not share, sell or disclose any information collected through our website to third parties.

The basis on which we deal with
information about you

We are required by law to determine, on six defined bases, what different categories of personal information we process and to inform you of the basis for each category.

If a basis on which we process your personal information is no longer relevant, we will immediately cease processing your data.

If the basis changes, as required by law, we will inform you of the change and of any new basis on which we have determined that we may continue to treat your information.

Information we process
because we have an obligation
contractual with you

When you create an account on our website, purchase a product or service from us or otherwise agree to our terms and conditions, a contract is formed between you and us.

In order to perform our obligations under this agreement, we must process the information you provide to us. Some of this data may be personal information.

We can use them for:
verify your identity for security purposes
sell you products
provide you with our services
provide you with advice and recommendations on products, services and how to get the most out of our web site
We process this information on the basis that there is a contract between us or that you have requested that we use the information prior to entering into a legal contract.

In addition, we may aggregate this information in a general manner and use it to provide information in a general manner, for example, to monitor our performance in connection with a specific service we provide. If we use it for this purpose, you as an individual will not be personally identifiable.

We will continue to process this information until the contract between us ends or is terminated by either party in accordance with the terms of the contract.

Information we process
for purposes of legitimate interests

We may process information on the basis of a legitimate interest, both for you and for us, in doing so.

When we process your information on this basis, we do so after careful consideration:

  • whether the same objective could be achieved by other means if the treatment (or lack of treatment) could cause you harm
  • whether you would expect us to process your data
  • if, ultimately, you would consider it reasonable for us to do so.

For example, we may process your data on this basis for the following purposes:

  • registration for proper and necessary administration of XbitAgency
  • response to unsolicited communications from you to which we believe you would expect a response
  • protection and assertion of the legal rights of any party
  • securing or obtaining professional advice necessary to manage XbitAgency’s risk
  • protect your interests when we believe that we have a duty to do so

Information we process
because we have a legal obligation

We are subject to the law like everyone else. Sometimes, we must process your information to comply with a legal obligation.

For example, we may be required to provide information to legal authorities if they request it or if they have proper authorization, such as a search warrant or court order.

This could include your personal information.
